Manyarara JA:
The appellant had been convicted of negligent driving. At his trial, which took place 26 months after the commission of the offence, he had been defended by a law officer from the Attorney-General's office.
Held that it was undesirable for an accused person to be represented at a criminal trial by a law officer from the Attorney-General's office.
Held that a constitutional issue must be raised in the trial court for reference to the Supreme Court.
